THE CASHBACK AND REWARDS PROGRAMME TERMS AND CONDITIONS: -

THESE TERMS AND CONDITIONS ARE TO BE READ TOGETHER WITH THE BAYO PREPAID CARD TERMS AND CONDITIONS. IF THERE IS ANY CONFLICT OR DISCREPANCY BETWEEN THE TWO IN RESPECT OF THE CASHBACK AND REWARDS PROGRAMME, THESE TERMS AND CONDITIONS WILL CARRY THE SAME MEANING AS DEFINITIONS FOUND IN THE BAYO PREPAID CARD TERMS AND CONDITIONS. FURTHERMORE, THESE TERMS AND CONDITIONS MAY BE SUPERSEDED BY VARIATIONS, REVISIONS, OR CHANGES FROM TIME TO TIME AND AT ANY TIME, SUBJECT TO ADEQUATE PRIOR WRITTEN NOTICE TO YOU. TO THE FULLEST EXTENT PERMITTED BY LAW, YOUR RETENTION OR USE OF YOUR BAYO PREPAID CARD AFTER THE EFFECTIVE DATE OF SUCH VARIATIONS, REVISIONS OR CHANGES WILL CONSTITUTE YOUR ACCEPTANCE OF SUCH VARIATIONS, REVISIONS OR CHANGES WILL CONSTITUTE YOUR ACCEPTANCE OF SUCH VARIATIONS, REVISIONS, OR CHANGES BY YOU WITHOUT ANY RESERVATION.

IF THE CUSTOMER DOES NOT UNDERSTAND ANY OF THE TERMS AND CONDITIONS, THE CUSTOMER MAY CONTACT BPSB CUSTOMER SERVICE FOR CLARIFICATIONS.


1   DEFINITIONS

Account means a BPSB’s prepaid account assigned to a customer which linked to the Payment Instruments held by a Customer where (i) funds are store; (ii) payments for purchases of goods and services effected by the use of Bayo Prepaid Card by the Customer; and (iii) all fees and/or charges are debited.
Authorized Merchant means any retail or other person, firm or corporation which pursuant to a merchant agreement, agrees to accept or cause its outlets to accept Bayo Prepaid Card when properly presented.
Bayo Prepaid Card means EMV compliant chip card where the card's monetary value is maintained on the BPSB’s system.
Biller(s) means the list of billing services made available in BPSB’s Mobile App to the Customer for the payment of bills.
BPSB means Bayo Pay (M) Sdn Bhd (Registration Number: 1191346-P)
BPSB’s Mobile App means BPSB’s mobile application running on an application software running on a device where Customer can register and apply for the Bayo Prepaid Card activate, access, set and edit Account.
Business Day means a day in which BPSB is open for business.
Customer means the person to whom the Bayo Prepaid Card is issued and registered.
Payment Instrument means payment mode in the form of physical Bayo Prepaid Card, Mobile Wallet or online Virtual Prepaid Card issued by BPSB approved by BNM accompanied with BPSB’s Services governed by these Terms and Conditions.
Mobile Wallet means payment option which is performed via a mobile device where the mobile wallet’s monetary value is maintained on the BPSB system;
Product means any goods or merchandise provided by the Authorised Merchant.
Programme(s) means the programme allowing the Customers to earn Rewards Points using the Card and Mobile Wallet App as specified in these Terms and Conditions.
Reward(s) means cashback, which can be redeemed by the Customers with their Rewards Points.
Rewards Points means the points earned by the Customers using the Card and Mobile Wallet App as specified in these Terms and Conditions.
Rewards Pool means the points allocated by BPSB for the Customer who is using Bayo Prepaid Card and Mobile Wallet App issued by BPSB as specified in these Terms and Conditions.
Virtual Prepaid Card means online payment option which is accepted online via BPSB’s Mobile App and its monetary value is maintained on the BPSB’s system.


2  ELIGIBILITY

2.1  Registered Customers whose account status is active, are eligible for the Cashback and Rewards Programme. BPSB reserves the right to modify the list at any time without prior notice.

2.2  Notwithstanding anything else stated in these terms and conditions, the following Customers are NOT eligible for the Cashback and Rewards Programme Features:

(a)   Any Customer whose account has been cancelled or terminated for whatsoever reason;

(b)   Any Customer who has committed any fraudulent or wrongful act or unauthorised transactions in relation to the use of the Bayo Prepaid Card, or Accounts; and

(c)   Any Customer who has committed an event of default inclusive but not limited to breaching any of the laws of Malaysia, rules, and regulations other than mentioned in 2.2(b).

2.3  BPSB may cancel or reverse any points awarded if we find they were awarded in error or if they were awarded in relation to any transaction which is later reversed for any reason.

2.4  BPSB reserves the right to amend:

(a)   the number of Rewards Points required to redeem Rewards;

(b)   the transactions eligible for earning of points;

(c)   the manner in which points are awarded; and

(d)   as well as the procedures in making the redemption.


3   PROGRAMME PERIOD AND REWARDS POOL

3.1   The Programme shall be an on-going base offering to eligible Customers. Continuation, or suspension of the Programme shall be subject to the sole discretion of BPSB.

3.2   During the programme period, BPSB may choose to run other programmes or campaigns concurrently with the base Programme.

3.3   For this Programme a total pool of 10,000,000 points will be given out to eligible Customers throughout the Programme period until the Rewards Pool runs out (first come-first serve basis).


4   REWARDS POINTS EARNING

4.1   The Transactions of the Customer shall earn points as follows:

4.2   Rewards Points balance will be dependent on the processing timeframe of the transactions and might take several days to be reflected. If the Customer does not dispute the number of Rewards Points earned after fourteen (14) Business Days from the crediting of the Rewards Points, the Rewards Points earned shall be deemed correct.

4.3   Transactions made on the following categories and other than stated in 4.1 above shall not be eligible for the Rewards Points collection. This includes: -

(a)   Funds transfer via peer-to-peer and FPX;

(b)   Domestic and International ATM cash withdrawal;

(c)   Reloads or top-ups into account;

(d)   Fraudulent and/or unauthorised transactions, be excluded from the Programme and shall not earn any Rewards Points; and

(e)   BPSB may from time to time add to, or remove from, the above list of included and/or excluded transactions.

4.5   BPSB’s decisions as to what transactions are included or excluded for the purpose of earning Rewards Points shall be final and conclusive.

4.6   All Rewards Points are valid only within their stipulated periods.

4.7   Fraud, abuse, and violation relating to the earning of Rewards Points in the Programme may result in the forfeiture of accumulated points.

4.8   You may view your accumulative Rewards Points via Mobile Wallet App.

4.9   Rewards Points are non-transferable and cannot be exchanged to redeem any other Reward Programmes offered by BPSB.

4.10  BPSB reserves the right to modify, suspend or discontinue any and all of the reward programmes at any time without prior notice.

4.11  If a customer files a dispute against a transaction that has earned Rewards Points, the earned Rewards Points will be debited if the investigation results to a valid dispute.

4.12  For the avoidance of doubt, BPSB reserves the right to reverse the Rewards Points at any time when there is valid reason to do so. Circumstances where reversal of Rewards Points may occur includes cancellation of transaction due to refund, fraud, error, and unauthorised transactions.


5   REDEMPTION

5.1   Rewards Points earned from the Programme can be redeemed as cashback rewards.

5.2   The points rewarded shall be accumulated into the Mobile Wallet App and can be redeemed as cashback after the Customer performs the redemption.

5.3   Points are redeemable by eligible Customers whose Mobile Wallet App status is active at the point of redemption.

5.4   The minimum number of Rewards Points required to be eligible for redemption is 2000 points.

5.5   The base point conversion is 2000 Rewards Points equivalent to RM1.00 cashback (rounding to the nearest cents).

5.6   Cancellations are not allowed once you have made a request for redemption.

5.7   The Rewards Points are redeemable at any time during their applicable validity period failing which they will expire and be forfeited without further notice to the Customer.

5.8   The Rewards Points redeemed will be deducted from your total Rewards Points balance and you may view the balance of your Rewards Points directly via Mobile Wallet App.

5.9   To redeem Rewards Points, the Customer must not have violated any the Programme’s Terms and Conditions.

5.10  It is possible to have negative points balance where the Rewards Points in the Customer’s account is shown in bracket. This situation might happen when the Customer redeems the Rewards Points, and a refund happens after the redemption. The system will auto reverse the Rewards Points earned for the refund transaction.

5.11  For negative points balance, future Rewards Points earned will be deducted from the negative balance and the Customer will be able to redeem again after collecting sufficient points for redemption

5.12  By redeeming Rewards Points under this Programme, the Customer is subject to the existing Terms and Conditions, including consents to the disclosure of the Customer’s information to third party service providers as needed to carry out any related request.

5.13  BPSB reserves the right at its absolute discretion to vary, delete or add to any of these Terms and Conditions and/or substitute or replace the cashback amount with another Product of equivalent value from time to time without any prior notice.


6   POINTS VALIDITY AND NOTICE OF ACCUMULATED POINTS

6.1   Rewards Points has maximum validity period of one (1) year and six (6) months. The frequency of expiry is two (2) times a year, on every 30th June and 31st December. For instance, points earned from January 2022 to June 2022 will expire on 30 June 2023 and points earned from July 2022 to December 2022 will expire on 31 December 2023.

6.2   The applicable expiry dates for Rewards Points earned will be shown in the Mobile Wallet App and points earned but not redeemed will be forfeited on their respective expiry dates.

6.3   The customer is responsible to keep track of the expiry date of the Rewards Points collected, thus BPSB shall not be held liable for any expired Rewards Points that had not been redeemed.


7   CHANGE TO THE AGREEMENT

7.1   BPSB may at its absolute discretion amend, vary or delete any of the Terms and Conditions herein at any time and from time to time by giving a twenty-one (21) days’ notice.

7.2   Any such amendment shall be effective and binding on the Customer from the date specified in the notice which may be given to the Customer in any one of the following manners:

7.3   The customer is responsible to keep track of the expiry date of the Rewards Points collected, thus BPSB shall not be held liable for any expired Rewards Points that had not been redeemed.

(a)   by posting on BPSB’s Website;

(b)   by displaying at BPSB’s premises;

(c)   by electronic mail to the Customer last known electronic mail address in BPSB’s records;

(d)   by ordinary post to the Customer last address in BPSB’s records;

(e)   by short messaging system (SMS); and

(f)   by notice to the Customer in any other manner as BPSB may deem fit.

and the Customer shall be considered to have accepted the changes and agreed to such amendments if the Customer continues to keep or use the Bayo Prepaid Card thereafter.


8   TERMINATION FORFEITURE OF EARNED POINTS

BPSB reserves the right to suspend or exclude any Customer from participating in or continuing to participate in the Programme if the Customer has, in any way, breached the existing BPSB’s Terms and Conditions and the Rewards Programme Terms and Conditions.


9   DISCLAIMERS

BPSB has taken and will take all reasonable steps to ensure that the information it publishes in relation to the Programme is accurate. However, BPSB shall not be liable or responsible for the genuineness or accuracy of any information given or provided by third parties.
